The undersigned ("Visitor") or, if applicable, Visitor's parent and/or legal guardian ("Parent/Guardian"), understands that visiting the San Francisco Society for the Prevention of Cruelty to Animals ("SF SPCA") may present possible risk of injury or harm due to inherent dangers of the SF SPCA premises, including but not limited to the presence of live animals (dogs and cats) which are unpredictable by nature, tripping hazards, slippery floors, commercial-grade cleaning solutions, scents and odors, among other potential risks to safety or comfort. SF SPCA will make every reasonable effort to make your visit safe, but cannot guarantee the avoidance of unforeseeable events and conditions. Visitor and/or Parent/Guardian assumes any and all risks associated with the foregoing and hereby agrees to hold the SF SPCA harmless from any loss or damage that Visitor may suffer as a result thereof.
Visitor and/or Parent/Guardian further agree to release, indemnify, and hold harmless the SF SPCA and its directors, officers, employees, contractors, agents, affiliates, and successors and assigns from and against any claim which Visitor, Parent/Guardian, other legal guardian(s), or any other person, may have for any losses, damages, or injuries arising out of or in connection with Visitor's visit/tour. The SF SPCA shall not be responsible to Visitor and/or any other person for illness, injury or damage to or loss of property due to Visitor's own acts or omissions.
Visitor and/or Parent/Guardian hereby expressly waives the provisions of California Civil Code Section 1542 which states as follows:
A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
