Photo Waiver Form

San Francisco Society for the Prevention of Cruelty to Animals (“SF SPCA”) is a nonprofit organization whose mission is to save and protect animals, provide care and treatment, advocate for their welfare, and enhance the human-animal bond. I would like to help SF SPCA further its charitable mission by allowing the SF SPCA to use photos, video and audio recordings, whether in print, electronic, or other format as described below.(Required)

I, the undersigned, hereby consent, release and agree to the below. This form may only be completed by adults (18 and over). A parent/legal guardian must complete this form for their minor children (17 and under).

Consent
I consent to the use by the SF SPCA of my, my minor child’s (as applicable), or my pet’s name, city and state of residence, biographical and personal background information that I have voluntarily disclosed to the SF SPCA, statements, voice, image, and likeness, in any format, including photos, video and audio recordings, whether in print, electronic, or other format (“Materials”), and grant to the SF SPCA the unrestricted, perpetual, and worldwide right and license to use the Materials as the SF SPCA determines, in its sole discretion, is appropriate to promote and otherwise carry out its mission at any time. I agree that the Materials may appear on its website, in its publications, or through any other media, including third-party social networking platforms. I understand that I am not entitled, and hereby waive any and all rights to, inspect or approve the use of the Materials, receive notice of their use or publication, or receive any payment.

SF SPCA’s Rights in the Materials
I grant to the SF SPCA all copyrights and other rights I may have in the Materials. I acknowledge and agree that the SF SPCA owns the physical Materials, as well as the content, any ideas or information they may generate, and the right to copy, edit, change, transfer, create derivative works of, or otherwise use the Materials as the SF SPCA sees fit. I confirm that I have all the rights and licenses necessary to make these grants. I understand that the SF SPCA is not obligated to exercise any of the rights granted under this release and agreement.

Revoking My Consent
I understand that I may revoke my consent at any time by sending a written notice to the SF SPCA Legal Department via email at legal@sfspca.org. Following receipt of notice, the SF SPCA will refrain from the use the Materials in future publications or media, but shall have no liability for use of the Materials prior to the receipt of notice.

Waiver of Claims
I hereby release the SF SPCA, its directors, officers, employees, agents, affiliates, and assigns from any liability and waive all claims with respect to the above, including any claims relating to copyright, rights of publicity or privacy, false light, or moral rights that I may have in the Materials or SF SPCA’s use and ownership of the Materials.
